My case Vasquez v. Franklin Management is now published at D.A.R. 60 (2014). The DLSE wanted this case published. Although the decision is favorable to employees who quit due to unpaid reimbursements and acknowledges that type of conduct can bring wages below minimum wage, the Appellate court got it wrong on intentional infliction of emotional distress. We have asked the California Supreme Court to depublish the portion about intentional infliction of emotional distress. Stay tuned for developments on this appellate issue.
