Employee live scans are an important pre-employment aspect of certain jobs including work with kids , security, and various public sector jobs. In general many employers have a number of pre-employment background and other tests employees must pass before being hired.
We receive a number of new client inquiries from employees who thought they would start working at a company, but were never able to. These are often difficult cases due to California employment laws.
Before quitting a job we recommend employees receive an assurance in writing from an employee capable of binding the company. The hire letter needs to omit at-will language which is irrelevant if employees are never allowed to work. Statements the letter does not create a contract are also problematic. A letter could say once employment begins the employee is subject to all normal employment practices if the employer does not want to create a contract. Watch out for letters that do not bind the company and give them the option to cancel the new job before it starts.
